These Terms & Conditions apply to purchases and use of the Malua online store available at maluashop.com (the “Store”). Please read them carefully before placing an order.

1. Quick summary (for easy reading)

  • Shipping: Orders ship from Poland via DHL. We usually hand parcels to DHL within 24 business hours after payment is confirmed (Mon–Fri).
  • Delivery time: typically 3–5 business days within the EU (may vary by destination).
  • Shipping cost: €10 for EU orders; free shipping on orders over €200.
  • Returns: 30 days to return your order after delivery. Items must be unused, unwashed, in original condition and with tags.
  • Refunds: We refund to the same payment method after we receive and inspect your return.
  • Gift cards: Valid for 12 months, redeemable in the Store, not exchangeable for cash.

3. Definitions

  • Customer / You – a person placing an order or using the Store.
  • Consumer – a natural person acting for purposes outside their trade, business or profession.
  • Product – goods offered in the Store (e.g., bedding, accessories).
  • Order – your offer to buy Products under these Terms.
  • Sales Contract – the contract concluded between you and us when we accept your Order.
  • Digital Content – content supplied in digital form (e.g., Gift Card).
  • Business Day – Monday to Friday excluding public holidays in Poland.

4. Using the Store

By using the Store, you agree not to provide unlawful content or misuse the Store (including reviews, forms or accounts). We may moderate or remove content that is unlawful, abusive or unrelated to the Store, and we may restrict access where required by law.

5. Products, prices and availability

  • Products offered in the Store are new and lawfully placed on the market.
  • Product descriptions and images are for information purposes. Slight differences (e.g., colour tone due to screens or natural linen variations) may occur.
  • All prices shown in the Store include VAT where applicable, unless stated otherwise.
  • Shipping costs are displayed at checkout and depend on destination and the selected delivery method.
  • Promotions and limited-stock items are available while stocks last.

Newsletter welcome discount (€10)

If you subscribe to the Malua newsletter, you may receive a one-time welcome discount of €10 (or the equivalent in your local currency). The local currency value is calculated using the official European Central Bank (ECB) exchange rate from the previous business day.

  • The welcome discount is single-use and applies to one order only.
  • It applies to the entire cart (unless stated otherwise in the message containing the code).
  • The code must be entered at checkout and cannot be applied retroactively after an order is placed.
  • The code may be subject to a minimum spend or other conditions stated at the time you receive it.

Combination: The €10 welcome discount can be combined with the 10% bundle discount described below.

Bundle discount (10% off bedding set)

When you purchase a full bedding set consisting of (1) a duvet cover, (2) a fitted sheet, and (3) pillowcases (pack of 2) in the same order, you receive a 10% bundle discount on those items in the cart.

  • The bundle discount applies only when the qualifying items are purchased together in one order.
  • The discount is applied at checkout (automatically or via a code, depending on the offer shown on the Site).

Combination: The 10% bundle discount can be combined with the €10 newsletter welcome discount (or local currency equivalent), as long as both promotions are valid at the time of purchase.

6. Placing an order and contract formation

  1. You can place Orders via the Store 24/7.
  2. To place an Order, add Products to your cart, complete checkout, and accept these Terms.
  3. After you place an Order, you will receive an automatic confirmation email acknowledging receipt. This is not yet acceptance of your Order.
  4. The Sales Contract is concluded when we confirm acceptance of your Order (usually by sending an order confirmation / dispatch confirmation).
  5. We may refuse or cancel an Order in justified cases (e.g., obvious pricing errors, stock issues, suspected fraud). If we cancel after payment, we will refund you.

7. Payment methods

We accept secure payment methods available at checkout, which may include:

  • Payment cards (Visa, Mastercard, Maestro) and vCards,
  • Apple Pay, Google Pay,
  • Klarna (if available in your country and at checkout),
  • Traditional bank transfer (where offered at checkout),
  • Country-specific payment methods (when available).

Payment must be completed before we dispatch your Order (unless a pay-later method is chosen and approved by the provider).

8. Shipping, delivery and risk

8.1 Dispatch time

  • We prepare and hand over orders within 24 business hours after payment is confirmed (Mon - Fri).
  • During peak periods, dispatch may take slightly longer; we will keep you updated by email.

8.2 Delivery methods, costs and typical transit times

  • Carrier: DHL (tracked).
  • We ship from Poland (EU).
  • EU shipping fee: €10. Free shipping over €200. UK shipping fee: £10. Free shipping over £200  
  • Typical EU transit time: 3–5 business days after dispatch (may vary by country and remote areas).

8.3 Address and failed delivery

  • Please check your shipping address carefully at checkout. After dispatch, changes may not be possible.
  • If you are not available at delivery, DHL may attempt re-delivery or redirect the parcel to a pickup point according to DHL rules.

8.4 Risk of loss and damage

For Consumers, the risk of accidental loss or damage passes to you when you (or a third party indicated by you) receive the parcel. If your parcel arrives damaged, please contact us as soon as possible and ideally within 7 calendar days of delivery, including photos of the packaging and products.

9. Returns (right of withdrawal) – 30 days

We want you to feel confident about your purchase. If something isn’t right, you can return your order within 30 days of receiving it — no reason needed.

9.1 Return conditions

To be eligible for a return, the item must be:

  • in its original packaging,
  • with all labels/tags still attached,
  • unused, unwashed and undamaged.

If you return the entire order and you received a free gift (give-away), the gift must be returned as well.

9.2 How to return an order

To make the return quick and smooth, please follow these steps:

Check if the item meets the return conditions above.

Fill out the return slip and place it inside the parcel (Return slip: (insert link on website / attach form)).

Pack your return securely so it arrives in perfect condition (we recommend using the original packaging).

Send the parcel back using a return label purchased from your local parcel service provider — we do not provide a return label.

Keep proof of postage until you receive confirmation that your return has arrived.

10. Refunds

  • After we receive and inspect your return, we will refund the purchase price using the same payment method you used for the Order (unless you agree otherwise).
  • We may withhold the refund until we receive the returned goods or you provide proof of return shipment (whichever happens first).
  • Refund processing time depends on your payment provider; in some cases it can take up to 14 days.

11. Complaints, defects and conformity of goods

If your Product is defective or not as described, you are entitled to remedies under applicable consumer law. Please contact us at hello@maluashop.com with your order number, a description of the issue and photos where helpful.

  • We respond to complaints within 14 days of receiving your request.
  • For Consumers, we are liable for lack of conformity that existed at delivery and becomes apparent within the statutory period (typically 2 years under EU rules, subject to local implementation).
  • Where appropriate, you may request repair, replacement, price reduction or withdrawal, in line with applicable law.

12. Gift cards

  • Gift cards are Digital Content redeemable in the Store for Products.
  • Gift cards are valid for 12 months from the date of purchase.
  • Gift cards are not exchangeable for cash (in whole or in part) and are not electronic money.
  • To redeem, enter the gift card code at checkout; the gift card value will be applied to eligible items and shipping where applicable.
  • If the order total exceeds the gift card value, the remaining balance must be paid using an available payment method.

13. Accounts, newsletter, reviews and other electronic services (digital services)
We provide certain electronic services through the Store, including:

  • placing orders and concluding sales contracts for Products,
  • creating and maintaining a Store account,
  • submitting and displaying reviews through our review system,
  • subscribing to our newsletter,
  • contacting us via the contact form or other available communication channels.

These electronic services are provided under the terms of these Terms & Conditions.

Account
Creating an account is optional unless required for a specific feature. You are responsible for keeping your login details secure and for all activity that occurs under your account.

Newsletter
If you subscribe to our newsletter, we will send you marketing messages by email using Klaviyo as our email service provider. Newsletter sign-up is voluntary and is based on your consent. You can withdraw your consent and unsubscribe at any time by clicking the unsubscribe link in any newsletter email or by contacting us at hello@maluashop.com. Unsubscribing will stop future marketing emails, but you may still receive non-marketing emails related to your orders or account.

Reviews
Reviews must be honest, lawful and relevant. We may remove reviews that contain unlawful content, hate speech, spam, personal data, or content that violates these Terms.

Advertising content
We may display marketing and advertising content on the Store website. Such content forms an integral part of the Store and the materials presented within it.

14. Intellectual property

All content on the Store (including text, graphics, photos and logos) is owned by or licensed to Malua/DOUBLE M sp. z o.o. and is protected by intellectual property laws. You may not copy or use it for commercial purposes without written permission.

15. Personal data and privacy

We process personal data in accordance with our Privacy Policy available on the Store. Please read it to understand how we collect, use and share information.

16. Limitation of liability

  • Nothing in these Terms limits or excludes our liability where it would be unlawful to do so (including for Consumers’ statutory rights).
  • We are not responsible for delays or failures caused by events beyond our reasonable control (force majeure), including carrier disruptions.

17. Governing law, disputes and out-of-court resolution

These Terms are governed by Polish law. If you are a Consumer, this does not deprive you of mandatory protections under the law of your country of residence (where applicable).

Where possible, we encourage amicable resolution first. Consumers may also use the EU Online Dispute Resolution (ODR) platform (if available): https://ec.europa.eu/consumers/odr.

For Consumers, the competent court will be determined under applicable procedural rules. For business customers, disputes are resolved by the court competent for our registered office, unless mandatory law provides otherwise.

18. Changes to these Terms

We may update these Terms from time to time for operational, legal or regulatory reasons. The latest version will always be available on the Store with an updated date.
